Standard Terms and Conditions for the Sale of Goods via E-Commerce Web Site

This agreement applies as between you, the User of this Web Site and EquineSpeedSkip, the owners of this Web Site. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should stop using the Web Site immediately.

No part of this Web Site is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a despatch email to you indicating that your order has been fulfilled and is on its way to you.

The conditions shall apply to all Contracts for the sale of Goods by us to you, by telephone or through our website. These terms do not affect your statutory rights. These Conditions set out the entire agreement to the exclusion of all other terms and conditions.

1.0 Definitions and Interpretation

1.1.1 In this Policy the following terms shall have the following meanings:

1.1.1 “Conditions” means the standard terms and conditions of sale set out below;

1.1.2 “Account” means collectively the personal information, payment information and credentials used by Users to access material on the website, and/or any communications system;

1.1.3 “Carrier” means any third party responsible for transporting purchased Goods from our Premises to customers;

1.1.5 “Goods” means any products that EquineSpeedSkip advertises and/or makes available for sale through this Web Site;

1.1.6 “Payment Information” means any details required for the purchase of Goods from this Web Site. This includes, but is not limited to, credit/debit cards numbers, bank account numbers and sort codes;

1.1.7 “Purchase Information” means collectively any orders, invoices, despatch notes, receipts or similar that may be in hard copy or electronic form;

1.2 Unless expressly stated otherwise, where rights and decisions are exercised or made at our discretion, then we shall be under no duty or obligation to you to justify or provide a reason for the decision.

1.3 Unless expressly stated otherwise, where our prior written consent is required in these Conditions, then we shall be under no obligation not to unreasonably withhold or delay in giving that consent.

In using our website, you agree to be bound by its Conditions of use as follows:

2.0 Accounts

If you open an account with us, you agree to be responsible for ensuring that your account details remain confidential and agree to accept responsibility for all activities occurring under your account. It is recommended that you do not share your Account details, particularly your username and password.

2.1.1 If you have reason to believe that your account details have become known to another person or that your account is being misused you must contact EquineSpeedSkip immediately to suspend your Account and cancel any unauthorised purchases that may be pending. Please be aware that purchases can only be cancelled until they are despatched. In the event that an unauthorised purchase is despatched prior to your notifying us of the unauthorised nature of the purchase, EquineSpeedSkip accepts no liability or responsibility and you should make contact with the Carrier, details of whom are available by contacting us.

3.0 Availability of Web Site

Whilst we aim to keep all communications and transactions via our Web Site free from interruption and failure, EquineSpeedSkip accepts no liability for any disruption or non-availability resulting from external causes including, but not limited to ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, and acts of war. It may be necessary to interrupt the availability of our Web Sit without notice as required to perform essential maintenance and repair and as such the Web Site will be available on an “as is” and “as available” basis.

4.1 All Content included on the Web Site, including, but not limited to, text, graphics, logos, icons, images, page layout, underlying code and software is the property of EquineSpeedSkip. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.

4.2 You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web site or unless given express written permission to do so by EquineSpeedSkip.

4.3 Where we have displayed any image, logo or object on our Web Site of which we are not the owner, to the best of our knowledge we have obtained the necessary consents and permissions from those third party owners prior to use or reproduction.

5.0 Your Personal Data

5.1 Any personal data held or processed by us is stored securely in accordance with the principles of the Data Protection Act 1998.

5.2 Unless we are obliged or permitted by law to so, your Data will not be disclosed to third parties.

5.3 Our online payment system uses industry standard 128-bit secure communications (SSL). At +no point will your credit/debit card details be transmitted over the internet or stored in our database in an unencrypted format. 6.0 International Customers

We are happy to deliver goods outside the UK, please email us for a delivery quote. Goods ordered from outside the UK, may incur import duties and taxes once your Goods reach their destination. EquineSpeedSkip is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and EquineSpeedSkip cannot guarantee that the packaging of your Goods will be free of signs of tampering.

This Web Site may contain links to other sites. Unless expressly stated, these sites are not under the control of EquineSpeedSkip. We assume no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves or of those in control of them.

8.0 Goods, Pricing and Availability

8.1 Whilst every effort has been make to ensure that all descriptions of Goods available from EquineSpeedSkip correspond to the actual Goods, EquineSpeeedSkip is not responsible for any variations from these descriptions. However, every care will be taken to ensure colours are correct. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether.

8.2 EquineSpeedSkip does not represent or warrant that such Goods will be available. Stock indications are not provided on the website.

8.3 All pricing information on the Web Site is correct at the time of going online. EquineSpeedSkip reserves the right to change prices as necessary.

8.4 In the event that prices are changed during the period between an order being placed for Goods and EquineSpeedSkip processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price.

9.0 Delivery

9.1 You can have your Goods delivered either to your own address or to an alternative delivery address. Where we are unable to affect delivery of the Goods for reasons that can be attributed to inaccurate or incomplete delivery information we will not be held responsible for any losses you may incur as a result.

9.2 If you specify that the Goods can be left either with a third party or at an alternative location, once the Goods has been delivered either to you (or a third party in accordance with your instructions) you will become the owner of the Goods and as such responsibility of the Goods will pass to you. Save for our negligence, we will not accept any liability for any subsequent damage or disappearance of the item following delivery in accordance with your instructions.

9.3 Our standard delivery charge of �4.75 covers the majority of postcodes on the UK mainland. Please contact us for postage to other areas. Despatch will be by Royal Mail or by contracted carriers for multiple purchases. Free delivery is available on orders of 3 or more units and delivery charge will be automatically deducted from the total price of your order at checkout on the Web Site. We aim to despatch goods within 3 – 5 working days.

9.4 International addresses and postcodes in more remote areas of the UK will incur an additional delivery charge (which will be reasonable to cover the actual costs incurred in delivering the Goods) please e-mail us for a delivery quote. However, this additional charge is not included in any free delivery offer.

9.5 Although we make every effort to keep you informed of delivery information, we do not undertake to investigate delays until 10 days after the original, or revised communicated despatch date. We will only recognise that a delivery has failed after 28 days from the time of despatch.

9.6 If temporary unavailability of Goods on your order causes despatch to be delayed for more than 3 days, we will contact you to advise of estimated delivery date.

9.7 If EquineSpeedSkip receives no communication from you within 14 days of delivery, regarding any problems with the Goods, you are deemed to have received the Goods with no problems.

10.0 Warranty and Liability

EquineSpeedSkip aims to always provide high quality Goods that are fault free and undamaged. On occasion however, goods may need to be returned. Returns are governed by these Terms and Conditions.

10.1 Subject to the following provisions, we warrant that the Goods will be of satisfactory quality, fit for their normally intended purpose and will be free from defects in material workmanship for a period of 12 months from the date of their initial use or delivery, whichever is the first to expire.

10.2 Where you make a valid claim to us in respect of any of the Goods supplied which is based on either a defect in the quality or condition of the Goods or a failure to meet the specification ordered, you will have the option of either having replacement Goods or a full refund of any price paid.

10.3 The warranty given in Condition 6.1 above is subject to the following conditions and we shall be under no liability in respect of:

10.3.1 any defect arising from fair wear and tear, willful damage, negligence, abnormal working conditions, failure to follow our instructions (whether oral or in writing), misuse or alteration or repair of the Goods without our approval;

10.3.2 any attempt made by you or any third party to remedy a defect before the Goods in question have been returned for inspection, (if so required);

10.3.3 any Goods alleged to be defective shall be returned to us at your risk and expense to our premises for inspection and in our reasonable opinion consider the Goods to be defective solely by reason of faulty design materials or workmanship.

10.4 Save for already provided in this Condition 6, our liability for death or personal injury caused by our negligence shall be unlimited and for all other loss or damage which you may suffer or incur in connection with the supply of Goods under this Contract caused by a natural and reasonably foreseeable consequence for which we are at fault or negligent, our liability shall be limited to twice the value of the price paid for the Goods.

11.0 Returns Policy

11.1 If you receive Goods which do not match those that you ordered, unless accompanied by an explanatory note detailing the changes, stating reasons for the changes and setting out your options, you should contact us within 14 working days to arrange collection and return. You will be given the option to have the Goods replaced with those ordered (if available) or to be refunded through the payment method used by you when purchasing the Goods. Refunds will be made within 14 days of being notified of your intention to cancel subject to any deductions made to cover any costs we have incurred in recovering the Goods. Refunds and replacements will be issued upon our receipt of the returned Goods.

11.2 If any Goods you have purchased have faults when they are delivered to you, you should contact EquineSpeedSkip in writing, telephone or by email within 14 days of receipt to arrange collection and return. This is a reasonable period for you to inspect the Goods and we will not consider any claims which you make outside of this period. Upon receipt of the returned Goods, the price of the Goods as paid by you, will be refunded to you through the payment method used by you when purchasing the Goods.

11.3 If any Goods develop faults within their warranty period, you are entitled to a repair or replacement under the terms of the warranty.

11.4 If Goods are damaged in transit and the damage is apparent on delivery, you should sign the driver’s delivery note to the effect that the Goods have been damaged. If you do not do this, we reserve the right not to consider any claims where you later make a claim and the outer packaging is subsequently found to be damaged. In any event, you should report such damage to EquineSpeedSkip within 14 days and arrange collection and return. Upon receipt of the returned Goods, the price of the Goods, as paid by you, will be refunded to you through the payment method used by you when purchasing the Goods.

11.5 We reserve the right to have any allegedly faulty or damaged Goods returned to us for inspection prior to a refund or any credit being issued. Should we deem the complaint to be unjustified, we will inform you of our decision and return the Goods to you at your expense.

11.6 Where Goods are found to be damaged or of unsatisfactory quality we will waive any delivery cost in collecting the defective Goods and providing replacement Goods.

11.7 Return of Goods Procedure

We request that all Goods are returned in line with the Return of Goods procedure set out below. We will not be liable for any loss or damage to Goods returned to us and where this procedure has not been followed.

11.7.1 Please contact us at returns@equinespeedskip.co.uk or by telephone 01989 769435 for a Returns Merchandise Authority (RMA) number. Package the Goods securely taking all measures possible to prevent damage in transit and (where possible) return the original packaging.

11.7.2 On the outside of the packaging, clearly mark the Returns Merchandise Authority (RMA) number and our postal address:

11.7.3 We request that your original order reference number is stated on all correspondence with us and original documentation is returned.

11.7.4 If we have arranged to collect the parcel from you, please ensure it is available for collection at the arranged collection point and time. You will be responsible for any charges incurred should the collection of the Goods be unavailable at the arranged time and place.

11.7.5 If you are to return the parcel to us independently, please ensure you have adequate proof of delivery. We will not be liable for any Goods that have been lost in transit. We are happy to arrange collection from you at your cost via our chosen carrier and carrier charges are available on request.

12.0 Termination and Cancellations

12.1 If EquineSpeedSkip terminates your Account, any current or pending purchases on your Account will be cancelled and will not be despatched.

12.2 EquineSpeedSkip reserves the right to cancel purchases without stating reasons, for any reason prior to processing payment and despatch.

12.3 Any order may be cancelled by you, for any reason whatsoever up to 5 working days after the day following receipt of the Goods. If purchases are cancelled for any reason prior to despatch you will be refunded any monies paid in relation to those purchases.

12.4 To cancel an order, you must notify us in writing or by email within 5 working days after the day following receipt of the Goods.

12.5 If any Goods have already been despatched, you can either request a “return to sender” when the delivery is attempted, or you can accept the delivery and follow the Return of Goods Procedure detailed in Condition 7.7 above.

12.6 For all cancellations at the request of the customer, the customer will be responsible for any costs incurred in returning the Goods to us. Where you cancel an order under this Condition and do not return the Goods, you will be liable for delivery and return costs which we incur in collecting the Goods.

12.7 If you terminate your Account any non-despatched purchases will be cancelled and you will be refunded any monies paid in relation to those purchases.

13.0 Changes to the Service and these Terms and Conditions

EquineSpeedSkip reserves the right to change the Web Site, its Content or these Terms and Conditions at any time. Your will be bound by any changes to the Terms and Conditions from the first time you use the Web Site following the changes. If EquineSpeedSkip is required to make any changes to Terms and Conditions relating to sale of Goods by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

14.0 Law and Jurisdiction

These Terms and Conditions and the relationship between you and EquineSpeedSkip shall be governed by and construed in accordance with the Law of England and Wales and EquineSpeedSkip and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

When using the website, you are responsible for ensuring that your account details remain confidential and you agree to accept responsibility for all activities occurring under your account and password. If you believe this information has become known to someone else or that your account is being misused contact us immediately.

EquineSpeedSkip reserves the right to edit or remove content, refuse access to the website or cancel orders at our discretion. If we cancel an order it will be without charge to you and you will be notified immediately.

Our Contract (Order)

The information your provide will be used for billing and delivery purposes or for contacting you if we have a query. Once you have placed an order you will be sent an e-mail confirming receipt of the order and the order details. A contract between you and EquineSpeedSkip will only take place once the order has been accepted, processed and items despatched, at which point your credit/debit card will be charged.

Pricing

All products offered for sale are priced in pounds Sterling. EquineSpeedSkip.co.uk is/is not VAT registered.. Any customs or import duties due when your package reaches its destination country will be your responsibility.

Payment

We accept online payments through a secure environment by credit/debit card and transactions are shown in pounds Sterling.

Customs

Goods ordered for delivery outside the UK may be subject to import duties and taxes and any charges for customs must be paid by you. We have no control over these and do not know what they may be as customs policies vary from country to country. We would advise you to contact your local customs office for full details and regulations.

Goods should be returned unsoiled, unused and in all original packaging.

You are advised to obtain proof of postage as should a returned parcel become damaged or lost we will not be able to reimburse you.

Goods damaged through defective material or poor workmanship should be returned immediately and not continue to be used.
